TO THE FULLEST EXTENT PERMITTED BY LAW, SPORTS DATA SYSTEMS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR GAMBLING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ITS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Termination
WITHOUT ANY LIABILITY WHATSOEVER, SPORTS DATA SYSTEMS MAY AT ANY TIME AND WITHOUT NOTICE TERMINATE OR RESTRICT YOUR ACCESS TO THE SITE, IN WHOLE OR IN PART, FOR ANY REASON. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply. Any data we retain after termination is handled in accordance with our Privacy Policy.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating in any way to your use of the Site will be resolved by confidential binding arbitration administered in Alameda County, California, except that either party may bring an individual claim in small-claims court. YOU AND SPORTS DATA SYSTEMS EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT NEITHER PARTY MAY JOIN OR CONSOLIDATE CLAIMS WITH THOSE OF ANY OTHER PERSON OR PARTICIPATE IN ANY CLASS OR REPRESENTATIVE ACTION. Any claim must be commenced within one (1) year after it arises, or it is permanently barred.
15. State-Specific Provisions
Under California Civil Code Section 1789.3, California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting it in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
16. Changes to These Terms

17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent, and any attempt to do so is void; we may assign these Terms freely. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sports Data Systems regarding the Site.
